Terms and Conditions of Use
Welcome to MiceyStore. These Terms and Conditions of Use (“Terms”) constitute a legally binding agreement between you and Maurito Dawid Depinski (“we,” “us,” or “our”) governing your access to and use of our website, products, and services, including orders fulfilled from the United States and the European Union for customers worldwide.
Summary (not a substitute for the Terms): By using the site or placing an order you agree to these Terms, our Privacy Policy, and our store policies (e.g., Delivery & Shipping, Returns & Refunds).
Governing law: These Terms and your purchase contracts are governed by the laws of Poland (European Union). However, mandatory consumer protection rules of your country or state/province of residence (for example in the EU, UK, United States, or Canada) apply and, where they conflict with these Terms, they take precedence. Nothing in these Terms is intended to limit such mandatory rights.

1) Acceptance of Terms
By accessing or using our website, placing an order, or clicking “I agree” (or similar) at checkout, you accept these Terms and our Privacy Policy. If you do not agree, please do not use our services.
We may update these Terms from time to time for valid reasons (for example, legal changes, improvements to our services, or new features). Changes apply prospectively and become effective when posted on this page. We will not change the Terms retroactively for orders we have already accepted. Continued use of the site after changes are posted constitutes your acceptance of the updated Terms.
2) Eligibility; Account
You must be at least 13 years old to use the site and at least 18 (or the age of majority in your jurisdiction) to place orders. If you create an account, you are responsible for keeping your login details confidential and for all activity that occurs under your account.
We may, in accordance with applicable law, temporarily suspend or restrict access, close accounts, or cancel orders (for example, in case of fraud, abuse, or misuse). We will not do so arbitrarily and will inform you where required by law.
3) Orders; Availability; Made-to-Order Items
- Order process & acceptance. Your order is an offer to buy the products listed in your cart. We confirm receipt of your order by email, but a binding contract is formed only when we explicitly accept the order (for example, when we send a shipping or production confirmation) and charge your payment method.
- Made-to-order production. Many of our items (such as printed mugs and apparel) are produced on demand after you place an order. Because of this, production starts soon after payment is confirmed and stock is limited by our and our partners’ capacity.
- Personalization & custom content. If you provide text, images, or other content for personalization, you represent that you have all necessary rights to use that content and that it is lawful, non-infringing, and does not contain hate speech, illegal content, or violations of privacy. We may decline or cancel orders that contain content we reasonably consider unlawful or inappropriate.
- Availability. We do our best to keep availability information accurate. However, products, designs, and variants may be limited or discontinued at any time. If an item is unavailable after you order, we will either offer an alternative (if you agree) or cancel and refund your order.
- Separate shipments. Because we use multiple fulfillment locations, items in the same order may ship separately at no additional shipping cost to you.
4) Pricing; Taxes; Promotions
- Prices & currencies. Prices are primarily shown in U.S. dollars (USD) for our main U.S. market. In some cases, prices may also be displayed in euros (EUR) or other currencies for your convenience. The applicable currency and total amount will always be shown at checkout before you place your order.
- Taxes. We collect VAT, sales tax, or other applicable taxes where required by law. For customers in the European Union or the United Kingdom, VAT may be included in the displayed price or added at checkout, as indicated. For customers in the United States and Canada, applicable sales taxes may be calculated based on the shipping address and added at checkout. Any import duties or customs charges for cross-border shipments are handled as described in the Shipping and International Customers sections.
- Errors. We try to ensure that all prices and descriptions are accurate. If we discover an obvious error in the price or description of a product before accepting your order, we will contact you and give you the option to reconfirm the order at the correct price or cancel it. If we cannot reach you, we will cancel the affected part of the order and refund any amount paid.
- Promotions & discount codes. Coupons or promotions are subject to the terms stated in the offer (for example, validity period, minimum order value, or eligible products). Promotional codes cannot be sold or transferred, and we may cancel misuse (for example, publication on coupon sites contrary to the offer conditions) in line with applicable law.
5) Payments (Stripe & PayPal)
We accept major payment cards via Stripe and payments via PayPal. By submitting a payment, you authorize us (and our payment processors) to charge your selected payment method for the total amount of your order, including any applicable taxes, shipping costs, and duties displayed at checkout.
We do not store full card numbers on our servers. Payment processing is handled by third-party providers whose terms and privacy policies govern your use of their services. Transactions may require additional authentication (such as 3D Secure). If a charge is declined, please try another method or contact your bank or payment provider.
6) Shipping; Fulfillment; Risk of Loss
Fulfillment locations. We operate using multiple fulfillment locations, including production partners and warehouses in the United States and the European Union. Depending on product type, stock levels, and your delivery country, your order may be produced and shipped from either region. Some items in the same order may ship separately.
Processing & shipping times. Because most products are made-to-order, production typically takes around 1–3 business days, unless otherwise indicated on the product page. Shipping methods, prices, and estimated delivery times for each region are described in detail on our Delivery & Shipping page. These timelines are estimates and not guaranteed, as they may be affected by carrier delays, customs processing, or events beyond our control.
Customs duties & import charges. When a shipment crosses borders (for example, a parcel sent from the U.S. to the EU, or from the EU to a non-EU country), local customs authorities may impose import duties, taxes, or handling fees. Unless clearly stated otherwise at checkout, such charges are the responsibility of the customer as importer of record and are not included in our prices.
Risk of loss & title. For consumers in the EU/EEA and the UK, where we arrange the carrier, the risk of loss or damage to the goods passes to you when you (or a person you designate, other than the carrier) physically receive the goods. If you ask us to ship using a carrier you have chosen and we had no influence over, risk passes when we hand the goods to that carrier. For customers in other countries (including the U.S. and Canada), risk of loss generally passes to you when we deliver the goods to the carrier, to the extent permitted by applicable law. In all cases, title passes in accordance with applicable law and once full payment has been received.
Please inspect your packages promptly on delivery and contact us if items arrive damaged, defective, or missing. We will work with you to provide a repair, replacement, or refund as described in the Returns & Refunds section.
7) Cancellations; Returns & Refunds
- Cancellations before production. Because our products are made-to-order, production usually starts shortly after payment. If you wish to cancel, please contact us as soon as possible at hello@miceystore.com. We will try to cancel your order if production or shipment has not yet started. Once production has begun, cancellation may no longer be possible (except where you have a statutory right to do so).
- No change-of-mind returns for made-to-order items (store policy). As a general store policy, we do not accept returns or exchanges if you simply change your mind, order the wrong size, or no longer want the product, because items are produced specifically for you once you order.
- Defective, damaged, or incorrect items (always returnable). If your item arrives defective, damaged, or not as described, please contact us within a reasonable time (ideally within 14 days of delivery) with photos and your order number. We will repair, replace, or refund the affected item in accordance with applicable law and our Returns & Refunds Policy.
- EU/UK right of withdrawal. If you are a consumer in the European Union or the United Kingdom, the law may grant you a 14-day right of withdrawal for eligible distance contracts, meaning you can cancel without giving any reason within 14 days of receiving the goods. Certain items are exempt from this right, including goods made to your specifications or clearly personalised (for example, products with your own text, name, or custom design), and other exceptions defined by law. Where the right of withdrawal applies, we will honour it as described in our Returns & Refunds Policy, which also provides the withdrawal form and practical instructions.
- Local rights in the U.S. and Canada. In the United States and Canada, laws may require us to accept returns or provide remedies for defective products or for contracts that are not performed as promised. Our “no change-of-mind returns” policy does not affect your rights to a remedy where goods are faulty, damaged, or not as described under applicable federal, state, or provincial laws.
- Refund method. Approved refunds are generally issued to the original payment method used for the order. Processing times depend on your bank or payment provider.
8) International Customers
We ship to many countries worldwide. You are responsible for ensuring that ordering, importing, and using our products is lawful in your country or region. You are the importer of record for cross-border shipments and are responsible for any customs duties, taxes, or fees that may be charged by your local authorities, unless we explicitly state that such charges are included in the price or covered by us.
Shipping times, tracking availability, and delivery experiences may vary depending on destination, local postal services, and customs procedures. We cannot control delays caused by customs processing or local carriers, but we will assist you in tracking shipments and, where appropriate, in filing claims with carriers.
9) Intellectual Property
All content on the site—including text, graphics, logos, product images, icons, and software—is owned by Maurito Dawid Depinski or our licensors and is protected by Polish, EU, U.S., and international intellectual property laws. We grant you a limited, non-exclusive, revocable, non-transferable license to access and use the site for your personal, non-commercial use.
Trademarks & brand. The name MiceyStore, our logos, and our overall brand appearance (trade dress) are trademarks or unregistered trademarks of Maurito Dawid Depinski. Third-party names and logos remain the property of their respective owners and do not imply endorsement.
You may not use our branding, product photographs, or designs for commercial purposes without our prior written consent, except where mandatory law permits such use (for example, for lawful reviews or comparisons).
10) User Content (Reviews, Photos)
If you submit content (such as reviews, photos, or designs), you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, translate, create derivative works from, distribute, and display that content in connection with our business (including on our website, social media, and marketing materials), in any media now known or developed in the future.
You represent that you own or otherwise control all rights to the content you submit, and that it does not infringe any third-party rights or violate applicable law. We may remove content that we reasonably consider unlawful, offensive, or in breach of these Terms.
11) Prohibited Uses
You agree not to use the site or our products for any unlawful or harmful purpose. In particular, you must not:
- Violate any applicable law or regulation;
- Infringe intellectual property, privacy, or personality rights of others;
- Upload or transmit viruses, malware, or other harmful code, or attempt to disrupt the site;
- Harass, defame, threaten, or abuse other users or our staff;
- Use automated tools (bots, scrapers) to access the site without our permission, except where allowed by law;
- Use the site to resell or redistribute our content or designs without authorization.
12) Third-Party Services & Links
We use third-party services to operate our store (for example, payment processors such as Stripe and PayPal, print-on-demand production partners, and shipping carriers) and may link to third-party websites. We are not responsible for the content, terms, or privacy practices of third-party sites or services. Your use of those services is governed by their terms and policies.
13) DMCA / Copyright Notice
We respect the intellectual property rights of others. Although we are established in Poland, we respond to copyright complaints, including notices submitted under the U.S. Digital Millennium Copyright Act (DMCA).

Your notice should include: (i) your physical or electronic signature; (ii) identification of the copyrighted work and the allegedly infringing material; (iii) your contact information; (iv) a statement that you have a good-faith belief that use of the material is not authorized; and (v) a statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or an authorized agent.
14) Disclaimers
Except as expressly stated in these Terms or required by law, the site and products are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by applicable law, we do not make additional contractual warranties (for example, commercial guarantees) beyond those stated here.
However, nothing in this section excludes or limits your statutory rights, including any legal guarantees for consumers (such as rights concerning goods that are defective or not in conformity with the contract under EU, UK, U.S., or Canadian consumer laws). Where such rights exist, they apply in addition to these Terms.
15) Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages, such as loss of profits, loss of data, or loss of opportunity, arising out of or in connection with your use of the site or products.
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for intentional misconduct or gross negligence, or for your statutory rights as a consumer regarding defective or non-conforming goods.
For all other cases, and unless mandatory law requires a higher amount, our aggregate liability to you for claims arising out of a particular order will not exceed the total amount you paid for that order.
16) Responsibility for Your Actions
You are responsible for ensuring that your use of the site and any content you submit complies with these Terms and applicable law. To the extent permitted by applicable law, if your unlawful conduct or breach of these Terms causes us loss (for example, because you upload infringing content and a third party makes a justified claim against us), you agree to be responsible for those losses.
This section does not impose obligations on you that go beyond what similar laws would normally provide and does not apply to you in your capacity as a consumer where such obligations would be considered unfair under local consumer law.
17) Dispute Resolution & Governing Law
We aim to resolve issues quickly and fairly. If you have a concern or complaint, please contact us first at hello@miceystore.com and include your order number and a brief description of the problem. We will do our best to respond and seek an amicable solution.
These Terms and your purchase contracts are governed by the laws of Poland (EU), without prejudice to any mandatory consumer protection rules that apply in your country or state/province of residence.
If you are a consumer in the EU/EEA or the UK, you may bring legal proceedings either in the courts of your place of residence or in the competent courts in Poland. We will not deprive you of this right. For consumers in other countries (including the U.S. and Canada), you may have the right to bring claims before the courts of your home jurisdiction; we do not limit any such mandatory rights.
If you are an EU consumer, you may also use the European Commission’s Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr. Use of the ODR platform is optional and does not limit your right to go to court.
18) Miscellaneous
- Electronic communications. We primarily communicate with you by email and through the site. You agree that electronic communications (such as emails, order confirmations, and notices) satisfy any legal requirement that such communications be in writing, to the extent permitted by law.
- Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control (for example, natural disasters, strikes, carrier disruptions, or widespread outages), provided we take reasonable steps to mitigate their impact.
- Assignment. You may not assign or transfer your rights or obligations under these Terms without our consent. We may transfer our rights and obligations (for example, in case of a reorganisation or sale of the business), provided this does not reduce your statutory rights as a consumer.
- Severability; no waiver. If a court finds any provision of these Terms invalid or unenforceable, the remaining provisions will remain in full force to the extent permitted by law. Our failure to enforce a provision does not mean we waive the right to enforce it later.
- Entire agreement. These Terms, together with the policies referenced in them (such as our Privacy Policy and Returns & Refunds Policy), form the entire agreement between you and us regarding your use of the site and purchase of products, without prejudice to any mandatory legal rights.
